In the wake of continuing reports of 3G connectivity problems from an unknown percentage of iPhone 3G users, one Alabama woman has had enough: Jessica Alena Smith has reportedly filed a complaint against Apple and is seeking class action lawsuit status. The suit alleges that the iPhone 3G did not provide twice the speed as promised by Apple in the company's "Twice as fast. Half the price" marketing messages. The complaint reportedly covers breach of express warranty, breach of the implied warranty of merchantability, and unjust enrichment.


It was only a matter of time . . . and long past due . . .

Ms. Smith has a perfect point that is not entirely Apples fault, but they will bear the brunt of the action since they are the ones that provoked it.

Europe is 10 years ahead of the US in cellular technology, and only because of Apple opening Pandora's Box, are we, Worldwide, getting advanced/next generation services and products that we should have had long ago but haven’t since the companies that have been running the show have just chosen not to spend the “profits” it would take. Apple's actions, albeit haphazardly, have severely escalated the World Market to fever pitch to be the “iPhone Killer” or to be the one to have one. Why now, why not years ago did the current cell manufacturers and providers up the ante on their own? Afraid of losing customers as you are to the big new toy and services you should have released years ago, but sat on your hands and made us take whatever meager offerings and bloated plans you deemed us worthy of while taking record profits? Europe has had established 3G systems for years, along with superior phone technology that we in the US have screamed for for years with no action by any of the current providers. They're hopping now and not the same old way they have since Apple tipped the cart, but way better than currently in the US, the “industry standard”. If not, why are all the cellular manufacturers running to be the “iPhone Killer” and cell provider markets shifting so severely?

If not Ms. Smith, it would have eventually been someone and all she or they are doing is taking Apple to task on their "promises" by word and deed by making them step up not as they profess they are, but all the way, and not just as far as Apple wants to. This should have been done long ago and Apple put in its place and we would not be here having this discussion. Apple is notorious for their methods and secrecy and now they have made claims on many levels with several products that are not being lived up to and it is their own fault. Their actions with AT&T (bottom of the pile in service providers that shocked the World when announced) and the release of the Worlds industry jarring iPhone needs to match what they claim and not just expect us sheepish end users to sit and take it. We have had enough and know better from the abuse. The American consumer is done being lied to and wants what they now know can be had elsewhere in the World with no excuses. But Apple took it a notch higher and must live up to that. As Mr. Jobs admitted, they released MobileMe prematurely and are now paying the price for it in customer confidence to their admitted tune of a 90 day renewal extension on current accounts. That unfortunately will not fix the damage that has been done in consumers eyes. More will need to be done in the way of how Apple works in the future.

I agree with Ms. Smith's actions and will be watching very closely to this. Apple needs to drop the snotty covert attitude and play nice with their consumers and will learn that they will need to now that they are entering, for real this time, the Enterprise Market. We are getting tired of being dictated to and will no longer sit idly by and suffer the consequences of their poor and or preferred judgment. And they will now suffer from this in the Enterprise Market, because we/they, the EM, can not afford to play games and expect a product to live up to the hype or it and its creators get dumped. I can easily spend my next years budget of $10 Million USD on Dell as easily as Apple. But want to go Apple but am deathly afraid of their current inconsistencies. I’m not putting my neck on the line cuz they want to be Bozo’s. It’s up to you boys. They have had the opportunity many times in history to break the mold and revolutionize the industry on many levels, but have kept it coy. That won’t do these days with the new breed of educated and demanding consumer.

Hop to it boys! I want to buy a 3G and install a ton of Macs in a PC environment, but have waited for this very reason.
